Reckless imprudence consists in voluntarily, but without malice, doing or failing to do an act from which material damage results by reason of inexcusable lack of precaution on the part of the person performing or failing to perform such act, taking into consideration his employment or occupation, degree of intelligence, physical condition and other circumstances regarding persons, time, and place.
On the other hand, simple imprudence consists in the lack of precaution displayed in those cases in which the damage impending to be caused is not immediate nor the danger clearly manifest.

I just want to ask about the case of the Partas bus driver in the mishap of young actor AJ Perez. Can reckless imprudence be really filed against him WHEN IN FACT, it was the actor's van who overtook another vehicle which led to it hitting the incoming bus (which was charting the correct lane)?
this law is the most bullshit law create in our country. for example nakaparada ka na sa tabi binangga ka namatay yung sakay nung bumangga ikaw pa kakasuhan ng reckless imprudence resulting to blah blah blah.. may kasalanan ba ko nun wala di ba ako na nga binangga eh... sang part ka naging reckless dun???
db pag nakaparada ka lang naman... at wala kang ginagawa.. wala kang kaso! that was their fault. at sila ang pd mung kasuhan sa mga damages muh, kung may namatay sa kanila hindi mu un kasalanan and that was thier lost. hindi naman bullshit ang batas nato... u just don't know the elements...so don't judge things that you don't know.
hindi liable ung nakapark lang, magkakaroon lamang ng liability yung nakapark kung d nya tinulungan yung tao na naghihingalo pagkatapos nya bumangga sa nakapark...
